1. Definitions and Interpretation
In these Terms and Conditions, unless the context otherwise requires:
“Tamia Feeds” refers to Tamia Feeds, its owners, employees, agents, and authorized representatives.
“Customer” refers to any individual, farmer, institution, company, or entity placing an order or receiving products or services from Tamia Feeds.
“Products” include animal feeds, fodder, silage, farm inputs, agricultural products, and any related items supplied by Tamia Feeds.
“Services” include delivery, advisory support, sourcing, and any additional services offered by Tamia Feeds.
Headings are for convenience only and do not affect interpretation.
2. Scope and Acceptance of Terms
2.1 These Terms govern all quotations, invoices, sales, deliveries, and services provided by Tamia Feeds.
2.2 By placing an order, making any payment, or accepting delivery or collection, the customer confirms acceptance of these Terms in full.
2.3 Any conflicting customer terms shall not apply unless expressly agreed in writing by Tamia Feeds.
3. Products and Product Information
3.1 Tamia Feeds supplies animal feeds, fodder, silage, and other agricultural products subject to availability.
3.2 Product descriptions, specifications, and weights are provided in good faith and may vary slightly due to natural and production factors.
3.3 Such minor variations shall not constitute defects.
4. Pricing and Quotations
4.1 All prices are quoted in Kenya Shillings (KES) unless stated otherwise.
4.2 Prices may change without prior notice due to market conditions or input costs.
4.3 Transportation and delivery costs are excluded unless expressly stated and depend on the customer’s location.
5. Payment Terms
5.1 A 50% deposit is required to confirm any order.
5.2 The remaining balance is payable upon receiving the product, unless otherwise agreed in writing.
5.3 All payments made to Tamia Feeds, including deposits, part payments, and full payments, are strictly non-refundable.
5.4 Once payment has been made, no refunds shall be issued for cancellations, order changes, delivery delays, or customer unavailability.
5.5 Orders will not be processed or released until required payments are received in full.
5.6 Payments may be made via M-Pesa or other approved methods communicated by Tamia Feeds.
6. Order Processing and Availability
6.1 Orders are processed subject to product availability and operational capacity.
6.2 Tamia Feeds reserves the right to decline or cancel orders due to stock limitations, pricing errors, or unforeseen circumstances without liability.
7. Delivery and Collection
7.1 Delivery timelines are estimates and depend on availability and customer location.
7.2 Customers may opt to collect products at an agreed time and location.
7.3 Risk and responsibility pass to the customer upon delivery or collection.
7.4 Tamia Feeds is not liable for delays caused by factors beyond its control, including weather, road conditions, or third-party transporters.
8. Inspection, Quality Assurance, and Complaints
8.1 Customers must inspect products immediately upon delivery or collection.
8.2 Any complaints regarding quality or quantity must be reported within twelve (12) hours via email, SMS, or WhatsApp.
8.3 Verbal complaints will not be accepted.
8.4 Claims made outside this period or after improper handling or storage shall not be accepted.
9. Cancellations, Returns, and Refunds
9.1 Order cancellations must be communicated promptly.
9.2 All payments are final and non-refundable, regardless of order cancellation, non-collection, or change of mind by the customer.
9.3 Returns will only be considered at the sole discretion of Tamia Feeds and do not constitute a right to a refund.
10. Customer Responsibilities
The customer agrees to:
Provide accurate delivery and contact details.
Ensure accessibility at the delivery location.
Properly handle and store products to maintain quality.
11. Limitation of Liability
11.1 Tamia Feeds shall not be liable for indirect or consequential losses arising from product use.
11.2 Liability, where applicable, shall not exceed the value of the product supplied.
12. Force Majeure
Tamia Feeds shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, strikes, or supply disruptions.
13. Intellectual Property
All branding, logos, content, and materials remain the exclusive property of Tamia Feeds and may not be used without written consent.
14. Amendments
Tamia Feeds reserves the right to amend these Terms at any time. Updated Terms shall apply to all new orders.
15. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.
